General sales terms

All contracts are subject to the Dutch Ship Suppliers Conditions, including the jurisdiction clause, as deposited at the Chamber of Commerce of Rotterdam. These conditions can be consulted at https://nvvs-online.nl/leveringsvoorwaarden/ and will be sent upon request free of charge. Any general conditions of the Buyer are explicitly rejected.” Any disputes shall be submitted to the jurisdiction of the Court of Rotterdam, the Netherlands, this court having exclusive jurisdiction. However NeKo Ship Supply B.V.  may, at its sole option, also bring suit against the Purchaser (as defined in the Dutch Ship Suppliers Conditions)  before the Court at the place of domicile of the Purchaser, or the Court where a vessel or asset is arrested/attached or seized in relation to such dispute, or the Court where the Goods (as defined in the Dutch Ship Suppliers Conditions) were delivered. Dutch law is applicable. NeKo Ship Supply B.V. explicitly rejects the applicability of any general conditions of its contractual parties.
